Georgii Regis. An Act for Enlarging the Time granted by Two Acts of Parliament, for Repairs of the Piers of Bridlington alias Burlington, and for making the said Acts more effectual. Whereas by an Act passed in the First Year of the Reign of this present Majesty, Instituled, An Act to Revive and Continue an Act of the Eighth and Ninth Years of the Reign of His late Majestry King William, for Repair of the Piers of Bridlington alias Burlington in the East-Riding of the County of York, It was Enacted, That the said Act of the Eighth and Ninth Years of the Reign of his late Majesty King William the Third, and all the Duties and Sums of Money thereby granted and made payable, and every Clause, Matter and Thing therein contained, should, from and after the Twenty fourth Day of June, One thousand seven hundred and sixteen. Stand and be Revived, Continued, and Paid, for the Term of Fourteen Years, Videlicet, from the said Twenty Fourth Day of June, One thousand seven hundred and sixteen, until the Twenty fourth Day of June, One thousand seven hundred and thirty : And whereas for the greater Security of such Ships and Vessels as shall, from time to time, come into the Harbour of Bridlington, it is absolutely necessary. That both the said Piers should be Lengthened, and the whole South Pier be speedily Rebuilt (and most part there- of upon a New Foundation) and that New Jetties should be also Built, and other necessary Works made for the Security thereof; Be it Enacted for the Kings most Excellent Majesty, by and with the Advice and Consent of the Lords Spiritual and Temporal, and Commons in this present Parliament Assembled, and by the Authority of the same. That the Trustees by the said Act of the First Year of His present Majesty appointed, together with the Persons following. Videlicet, The Honourable Thomas Willoughby Esq. Sir William Osbaldeston Knight, Charles Hotham, William Osbaldeston, Francis Boynton, James Moyser, and Henry Barnard, Esquires ; or any Five or more of them, or such Person or Persons as they or any Five or more of them, by any Writing under their Hands and Seals, that Nominate and Appoint (by themselves, their Deputies, Agents, Workmen, and Servants) shall be, and are hereby Impowered and Authorized, and shall have full Power and Authority by this present Act, to Lengthen both the said Piers, Videlicet, The North Pier, not exceeding Sixty Feet, and the said South Pier, not exceeding Sixty Feet, and to Rebuild the South Pier, or any part thereof, in such manner, and upon such Foundation, as they the said Trustees, or any Five or more of them, shall think proper, and also to Build such Jetties and other necessary Works as shall be convenient for Completing, Finishing, Strengthening, and Preserving of the said Piers.
And where as the Money that will arise by the said Duty during the Continuance of the Term Granted by the said Act of the First Year of His present Majesty, and hereby Enlarged, will not be sufficient to defray the Charges and Expences of Lengthning the said Piers, and Rebuilding the said South Pier, and other Works necessary to be done for the Security thereof ; Be it therefore Enacted by the Authority aforesaid. That from and after the Twenty fourth Day of June, One thousand seven hundred and nineteen, for the Term of Thirty six Years, the several Additional Rates and Duties hereafter mentioned (over and besides the Duty or Duties Granted and Continued, as aforesaid, or Payable before the Passing of this present Act) shall be Raised, Levied, and Collected, That is to say; For every Quarter of Corn, Malt, or Grain, Exported from the Port of Bridlington alias Burlington, the Sum of One Peny half peny ; For every Hundred of Fir Balks, Imported into the said Port, the Sum of Five Shillings ; For every Hundred of Fir Deals, Imported into the said Port, the Sum of Three Shillings ; For every Hundred of Fir Spars, Imported into the said Port, the Sum of One Shilling : Which said Duties or Sums of Money shall be paid at the Shipping or Landing of the said Goods and Merchandizes by the Exporters and Importers thereof respectively : For every Ship or Vessel English Built, Entring the said Port, the Sum of One Shilling and Six Pence ; For every Top of such Ship or Vessel, the Sum of Four Pence ; For every Ship or Vessel Foreign Built, theSum of Three Shillings ; For every Top of such Foreign Built Ship or Vessel, the Sum of Eight Pence/ to be paid by the Masters of such Ships or Vessels respectively.
Provided, and be it Enacted by the Authority aforesaid. That all and every Person and Persons, Lands, Tenements, and Hereditaments, Tolls, Port-Duties, or other Duties, Sum and Sums of Money, heretofore Chargeable with, or Subject or Liable to the Building, Rebuilding, Repairing, Maintaining, or Upholding the Port, Pier, or Piers of Bridlington alias Burlington aforesaid, or the Walls, Jetties/ Sluices, Sockers, Locks, or other Works thereof, shall continue, and be chargeable with, and subject and liable to the Building, Rebuilding, Repairing, Maintaining, and Upholding the said Piers, and other necessary Works, after the said Piers, or either of them, or any part of them, or either of them, shall be so Lengthned, Altered, or Built on any new Foundation, as aforesaid, in the same manner as they respectively were Chargeable with, or Subject or Liable to the Building, Rebuilding, Repairing, Maintaining, or Upholding the same, before the said Piers, or either of them, or any Part of them, or either of them, were so Lengthned, Altered, or Built on any new Foundation.
And be it further Enacted by the Authority aforesaid. That if any Suit shall be Commenced against any Person or Persons or any thing done in pursuance of this present Act, that in every such Case the Action shall be laid in the said County of York, and not elsewhere ; and the Defendant or Defendants in such Action or Actions to be brought, may plead the General Issue, and give this Act, and the Special Matter in Evidence, at any Tryal to be had thereupon ; and if a Verdict shall pass for the Defendant or Defendants in such Action, or if the Plaintiff or Plaintiffs shall be Non-suit, or Discontinue his or their Action or Actions, after the Defendant or Defendants shall have appeared, or if upon Demurrer Judgment shall be given against the Plaintiff or Plaintiffs, the Defendant or Defendants shall and may recover Treble Costs, and have like Remedy for the same, as any Defendant or Defendants hath or have in other Cases by Law.
